Terms and Conditions

Fitness :- Soul-POLE involves rigorous physical exercise and is therefore intended and designed for a person of reasonable fitness and good health. By purchasing products or taking part in Soul-POLE you are warranting that to the best of your knowledge and belief, you are in reasonable fitness and of good health. Anyone not in reasonable fitness and of good health may suffer physical injury by participation in the exercise involved in Soul-POLE. When applying for membership or by purchasing any classes from Soul-POLE it is requirement of participation that you declare at time of application any medical or physical conditions which might put you at risk by participation in Soul-POLE. If you are in any doubt as to whether or not you have sufficient fitness to participate in Soul-POLE then you should consult your doctor before application for and participation in Soul-POLE. The proprietors of Soul-POLE reserve the right to request any potential students is of reasonable fitness and of good health and that there is no medical reason known to said medical adviser(s) why the potential member should not participate safely in Soul-POLE classes.

Class conduct:- By reading and agreeing to these terms and conditions you agree to: Show respect for your teacher. Give at least 48 hours’ notice if you need to cancel a pre-arrange class. If agreed cancellation notice is given no cancellation charge will be made and the class credit will be carried forward to next class or a replacement class will be provided as availability allows. If not you will lose the right to claim back monies for the missed class and will lose that class. You will not consume alcohol or any mind altering drugs before a class with Soul-POLE. Individual classes need to be booked one week in advanced and paid for in full on day of booking. Please do not moisturize before any pole class.

Soul-POLE Course all levels:- At time of booking a eight week course an option to pay half cost or full cost of course will be given to secure class times and dates. When taking the option to pay course fee in 2 payments you are committing to make final payment which will be taken of your chosen card within four weeks of your first payment.  If you need to cancel a class the same 48 hour policy as detailed in class conduct applies.

Refunds and cancellation Policy: – If for any reason you cannot attended or complete your pre-booked eight week course or any short courses provided by Soul-POLE two weeks’ notice before the start date of the course will need to be given and a refund for 50% of the course fee will be given. However if the eight week course has started no refund will be given. Gift vouchers are refundable if  requested by e-mail withing the 14 day cooling off period. Gift Voucher valid for six months after purchase date. 50% of cost of party will be refunded as long as there is two weeks’ notice given for cancellation any less and full cost is not refundable, this does not include the deposit for 6 people this is non-refundable. Pay As You Go, pole circuits, core-conditioning, open studio, back to basics, private group and any other drop in classes  sessions are paid for one week in advance you may arrange an alternative day for the class if you give 48 hour notice to cancel if you do not cancel and don’t show then you lose your class credit.

Membership’s cancelations:-Full monthly payment members: Termination by you: you may terminate this agreement in the following circumstances: (a) you can give notice to terminate at any point during the commitment Period but this cannot end your membership before the end of the commitment period.

(b)You may terminate your membership by giving one full calendar month written notice; so that your membership will terminate at the end of the following calendar month after given notice was given. (c) Cancelling your Direct Debit or Card Payment instruction for payment of fees is not sufficient. (d)Members must give at least 48 hour notice to cancel classes they have booked onto; they must notify Soul-POLE by logging onto their system and cancelling their place on scheduled class. If member proceeds to not show up to classes 3 times in any one given month than their ability to book classes will be withheld for the period of 1 month.

Party Zone:- The cost of 6 people must be paid for on the day of booking to secure your time and date this payment is non-refundable. Two weeks before the party date Soul-POLE will contact you to find out how many people are coming and collect the rest of the payment. The number of people must be stated along with any health concerns of participants. Participants must turn up on time and not under the influence of any substances such as alcohol or drugs. Soul-POLE reserves the right to exclude any participant from party if deemed unfit and if the greater amount of participants have been drinking Soul-POLE reserves the right to cancel party with no refund. Please do not moisturize before any pole party. Min booking 6 people max 30ppl; Wear Shorts and t-shirt to Pole Party No alcohol to be drunk before pole activities.

 

Party Disclaimer:- Soul-POLE may involve the brining of a portable pole to your home or any other venue agreed where the Soul-POLE exercises and parties will be carried out. The pole will require to be secure at top and bottom usually ceiling to floor. Whilst every reasonable care will be taken to avoid any damage caused in the securing of the pole. By purchasing any party or classes you irrevocably waive any claim whatsoever against Soul-POLE relating to any damage caused.

Non Pole Purchases:- Items bought at the shop non-pole items will be subject to suppliers T&C, Soul-POLE will replace any faulty items within 3 weeks subject to availability or a full refund will be given.

Monthly ordering: – Items ordered through Soul-POLE studio on our monthly ordering will need to have deposit paid to secure order. By paying the deposit to order you are agreeing to payment of final full cost of item when it arrives at Soul-POLE or you will lose your deposit. Items that are not suitable due to size will be returned and re-ordered within 2weeks as a replacement to fore fill original order.

pole purchase:- Anybody who purchases an X-Pole from Soul-POLE dose so at their own risk. You irrevocably waive any claim whatsoever against Soul-POLE relating to any damage caused. All X-Poles are sold with the correct instillation and maintenances information, you should only use the X-pole in the manner for which it was designed and take care. Always follow the instructions on the DVD and enclosed booklet and always warm up before to any form of exercise.

Orders:- Orders accepted by the company are subject to the terms and conditions below. Orders accepted by the company are subject to availability of stock. Acceptance of an order and therefore the existence of a contract of sale will only come into effect at the time when the company undertakes a delivery of stock to the customer.

pole warranty:-In the case of goods developing faults, the Company’s sales department should be notified in writing. Goods must not be returned under Warrantee until the Company’s consent has been obtained.  If, on examination of the goods, by the Company, we find that defects arise from faulty materials or workmanship, the Company will, at its option, repair or replace the goods free of charge.  Note:  The Company is unable to accept any liability save to the extent and in the circumstances described above.  In particular, The Company cannot be liable for any financial loss, injury or damage caused to the buyer or any other person caused by any defect in the goods except to the extent that its negligence caused it or contributed thereto.  The Company cannot therefore be responsible for the negligence of others.  Where the buyer sells the Company’s goods as the Company’s agent, he has no authority to make any representations or give any warranties relating to claims.

Claims:-

The Companies goods are sold subject to the implied terms as to quality, description and fitness contained in the Sale of Goods Act 1979.  It is the customer’s responsibility to examine the consignments of goods upon arrival for correct quality, description, shortages, plus any transit damage.  Claims MUST be made in writing or by phone to the Company’s Sales Department within 3 days of receipt of goods or within 14 days of the invoice date where the goods have become lost in transit.   Claims in respect of alleged faulty goods, shortages or non-delivery shall not be grounds for withholding payment of accounts and shall not give the customer the right to offset/contra against payments made to the Company.     The Company will not accept packing and carriage charges for customer returns unless agreed by a Director

Refunds will be made on the receipt of the goods once the warranty claim is agreed. Proof of return (registered post or similar) should be retained as no refund or exchange can be made until the goods are received. the goods or their fitness for any purpose.

Gift Vouchers:- If buying Gift Vouchers for a eight week beginners course the full course price must be paid, this also applies to Parties, Private Group, one2one’s  and Pay As You Go sessions.

Other Services: – All other services that are provided at Soul-POLE fitness and dance studio are run by independent operators and Soul-POLE in no way takes liability for their actions. Every care will be taken to assure that they are appropriate personnel but soul-POLE disclaims any responsibility for any liable procedures arising from misconduct of independent operators.

Hiring Poles: -If you come to Soul-POLE and hire a pole for your own exercise any responsibility to warm up is born to the hirer. Soul-POLE disclaims any responsibility for any liable procedures arising from any injury or from any miss use of pole by hirer. If you hire an Rpole from Soul-POLE to take home Soul-POLE disclaims any responsibility for any liable procedures arising from any injury or from any miss use of pole by hirer. By agreeing to hire soul-POLE’s Rpole you irrevocably waive any claim whatsoever against Soul-POLE relating to any damage caused to hire or that of the premises of hirer. If Rpole’s are not returned at agreed day and time a fee of £40 for every day late after hire agreement. The hire agrees that if any damage is done to the Rpole the hire will bare the cost of replacement alongside any related losses.
